US Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention

Legal scene

A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.

The case stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer alien smuggling allegations, he was held in federal custody.

In her decision, the judge pointed out that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The court challenge involve conflicting claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in Tennessee.

Terms of Release

The judge, who was hearing his challenge to removal in a federal court, ruled that he must now adhere to the terms of his release from custody in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.

This decision represents a significant development in a complex immigration case featuring claims of wrongful detention and contested gang affiliations.
